At least one commentary suggests that the believer, born of the Holy Spirit, can be 'in the flesh', but this doesn't seem to be at all what Paul is suggesting. The tension that Paul is working with is found all over the New Testament, and it is this--that not all of those who claim to be in Christ are truly born of the Spirit. Those who are truly born of the Spirit will undoubtedly exhibit a Spirit-led life of holiness. All who are born of the Spirit joyfully submit to the Law's demand of pure love to God and neighbor because the Law is holy and Spirit-inspired; the unspiritual person, devoid of the Spirit of God and in the flesh, is not only unable but also unwilling to submit to God who demands obedience from His creatures (the mind is 'hostile' to God). This does not mean that someone who is Spirit-filled will not disobey God and go astray from time to time, but that his or her life (having now been renewed in Christ) is not characterized by hostility to the Law's demand for real spirituality and holiness.
